Terms and Conditions as expressed by
Speanut
1.)
Speanut will only commence work on a
Project after receipt of 50% deposit
of the quoted project fee from the
Client. The final 50% payment is to
be made on completion of the
website. The website will be
switched to Live Mode once the
Clients remaining balance is paid in
full.
2.) The
initial 50% deposit paid to Speanut
covers the cost of design work
carried out. It is not possible to
refund a deposit once Speanut has
sent the first design to the client.
Speanut reserves the right to decide
whether or not a refund is
applicable if requested by the
client for any reason. A refund is
never guaranteed by Speanut but
could be possible if Speanut deems
the request to be lawful.
3.) The
client is responsible for
researching any website / business /
or idea to be legal to own and
operate within Canada.
4.)
Speanut cannot be held responsible
for anything adversely affecting the
client's business operation, sales,
or profitability that they might
claim is a result of a service
offered by Speanut.
5.)
Speanut does not host your website
upon completion of it getting built
but will suggest to the client some
reliable trustworthy companies who
can provide the hosting. Since the
hosting company will be a third
party company, Speanut can not
guarantee that the hosting will be
available at all times, especially
in the event of a technical failure
beyond control.
6.)
Where we have been asked to provide
SEO (search engine optimisation) for
a client, we can not guarantee any
specific placement or high ranking
on search engines. Single word
keywords are extremely completive in
most niches. Every effort will be
made to help you rank for your
desired keywords.
7.)
Speanut does not charge for open
source software. Any fees accrued
during working with open source
software is to cover the time and
resources needed. Open source
software is not owned by Speanut or
our client's.
8.)
Images used on the website design
for a client is the responsibility
of the client. Speanut can inquire
specific types of photos that can
legally used at the request of the
client, however a reimbursement from
the client is required on the final
bill amount.
9.)
Speanut will provide the client with
an expected project completion date
and will work to meet the agreed
upon date, however Speanut can not
make any guarantees and can not be
held financially or legally
responsible for meeting the set out
deadline date. Although Speanut will
do everything in our powers to
deliver on time we can not foresee
any problems or complications that
might arise while working on the
project.
10.)
Domain names can be purchased on the
clients behalf and kept in the
register of Speanut. Although
Speanut will be the register of the
domain name the client will remain
the owner of the domain name. If the
client would like the domain name to
be edited or transferred to a
different register then Speanut will
provide the services within a timely
manner. Yearly renewal fees will be
billed to the client as discussed.
11.)
Domain names that are registered by
the client and kept under the watch
of the client are not the
responsibility of Speanut. The
client takes full responsibility in
making sure the domain name is
renewed when due.
12.)
Hosting is the responsibility of the
client and making sure the renewal
fees are paid when due. An
arrangement for due dates and fees
will be made between the client and
the hosting company upon setting up
a hosting plan.
13.)
Speanut has no control of, or
responsibility for, the content of
our client's web sites. In no way
does the textual or image based
content of our client's web sites
constitute Speanut endorsement, or
approval of the web site or the
material contained within the web
site. Speanut has not verified any
of the materials, images or
information contained within our
client's web sites and is not
responsible for the content or
performance of these sites or for
the client's transactions with them.
Speanut provides links or references
to our client's websites solely for
the convenience of prospective
customers and intends that the links
it provides be current and accurate,
but we do not guarantee or warrant
that such links will point to the
intended client site at all times.
14.) The
client is expected to test fully any
programs, applications, programming,
or website developed by Speanut
before made live for use. Where
bugs, errors or other issues are
found after the site is live,
Speanut will work to correct any
issues to meet the standards of
function outlined in the
requirements free of charge for the
first 6 months.
15.)
Speanut is not held liable for loss,
damage or corruption to files or
information stored on the servers of
your hosting company or individual
PC's relating to a clients website.
The client is solely responsible for
any information or files relating to
their website.
